2021 Legislation: Insight and Legal Update

For the last two legislative sessions in a row, we have faced some of the most historically significant bills since the Davis-Stirling Act came into effect in 1986. And that’s saying a lot considering the Davis-Stirling Act has probably been amended more than a hundred times since it was enacted. This year was especially challenging on legislators, advocates, and citizens wishing to engage in the process, given the impact of the COVID-19 pandemic on the legislative process. It has also demonstrated the need for modernizing the Davis-Stirling Act by allowing for the use of mainstream technology which has become commonplace in our everyday lives.

Nominees Announced for CAI-CLAC 2019 Volunteer of the Year

The CAI California Legislative Action Committee (CAI-CLAC) is pleased to announce nominations were received from California CAI chapters and the Selection Committee, comprised of CAI-CLAC Chair, CAI-CLAC Vice-Chair and CAI-CLAC PR-Chair. The CAI-CLAC Administrator and Advocate also participated in the discussion, with the aforementioned three, being the voting members. The winner will be selected based upon the nominees work in promoting CAI-CLAC within his or her chapter.

CAI-CLAC wasn’t planning on going virtual this year. Let’s face it – none of us were! But when COVID-19 caused all in-person conferences and meetings to cancel their 2020 events, we, like everyone else, shifted to the virtual alternative. Governor Newsom Signs AB 3182

We are deeply disappointed that Governor Newsom signed Assembly Bill 3182 over the objections of CAI-CLAC and the more than 5,000 constituents who contacted his office to express their concerns. What is most insulting is that the Governor issued the notice of his signature of the bill in a press release touting the State’s effort to improve the housing affordability crisis in California.

That’s because it is a bad bill and will be harmful to community associations and their members throughout California if passed, for numerous reasons. AB 3182 Will Hurt California Homeowners and Small Business

I’ll get right to the point. If Assembly Bill 3182 (Ting) becomes law, it will have immediate negative consequences to the following groups of people: first time homebuyers, veterans, seniors and small business owners that provide essential services to HOA communities. All homeowners in California’s more than 55,000 Common Interest Developments (CIDs) will be affected. ALL OF THEM. Condominium associations will be hit the hardest, because lending requirements are the strictest. But this will trickle down to affect all CIDs.

CAI-CV Wins TEN National Awards

On May 15th, CAI announced the winners of their National Achievement Awards and Excellence Awards. The 64 CAI chapters from around the country and some of the international chapters compete based on chapter size. National Achievement Awards are given out based on submissions from each chapter in five categories. Submissions are reviewed and evaluated by a team of CAI chapter leaders. Excellence Awards are given out based on a comparative evaluation by CAI national staff in five areas considered critical for chapter success. CAI-CV won all ten categories for its programs in 2019. The awards will be given out at a ceremony planned at the National Convention in 2021 in Las Vegas. CAI-CV operates with over 150 volunteers who run all its programs through 16 committees. Congratulations to all CAI-CV members, committee leadership and volunteers, and to our esteemed board of directors.
