The Legislature is scheduled to reconvene this month, albeit on different days. The Assembly will return May 4, 2020, and the Senate on May 11, 2020. The Governor is scheduled to release a new budget on May 14, 2020.

The Assembly will hold a policy committee hearing for the first three weeks of May. Policy committees will be allowed only one hearing and the Chair will decide how many bills will be heard. Some committees are restricting their hearings only to COVID-19 or Economic Recovery related bills, others are not. Public participation will be limited. All hearings will be webcast.

The Senate has not yet released its process for the policy committee. However, the Senate does allow for remote voting and participation by its members, so the process will be different.

At this time, our CAI-CLAC sponsored bills have been placed on hold by our authors. SB 969, the SB 323 clean-up bill will not move this session, nor will the electronic notification legislation, SB 981, sponsored by the California Association of Realtors and opposed by CAI-CLAC unless amended to address our concerns. Our legislative agenda will not be as we envisioned. We are poised to be in a defensive posture.

For example, on April 30, 2020, Assembly Member Phil Ting amended AB 3182 to strike the language in Civil Code Section 4740 and include language to instead make void and unenforceable any governing document that purports to prohibit the rental or leasing of any separate interest in a common interest development. The bill is set for the Assembly Housing Committee on May 20, 2020. This is a direct attack on our ability to locally govern and we will fight it. Please stay tuned for our Call to Action.
